Hurst, Robin, Kay & Allen is pleased to announce that it has prevailed on appeal in a case known as In re the Marriage of Brubaker. In this case, our client sought to vacate or amend his Judgment for Dissolution of Marriage when he learned (four years after the fact) that his wife concealed her ownership interest in a valuable condominium. While HRK did not represent the client in the underlying divorce, we petitioned to have the Judgment set aside and obtain his share of the property. The trial court erroneously dismissed the claim. HRK immediately appealed and in a unanimous decision, the Appellate Court agreed, reversing the lower court’s dismissal. Thanks to the diligence and advocacy of HRK our client now has the opportunity to have his claim heard in full. The published decision of the Second District Appellate Court may be found here.
